Introduction

Welcome to BAT Trading Group Limited (“the Company”). These terms and conditions (“the Agreement”) govern your use of the Company’s services (“the Services”) under a limited license.

Binding Agreement

This Agreement is a legally binding contract. It is your responsibility to read it thoroughly before accessing the Services. By using the Services, you agree to all terms and conditions in this Agreement.

Changes to the Agreement

The Company may suspend, replace, modify, amend, or terminate this Agreement at any time at its sole discretion. Your continued use of the Services after changes to this Agreement signifies your acceptance of those changes.

Trader Representations

Nature of the Services

The Services include tools for simulated foreign exchange and other financial market trading, analytical tools, training and educational materials, access to the Client Section, and other ancillary services. Simulated trading uses financial market information; however, you acknowledge that such trading is not real. Funds provided for demo trading are fictitious and have no value outside the Services. You are not entitled to remuneration or profits from simulated trading unless explicitly agreed otherwise.

No Investment Services

The Services do not constitute investment services. The Company and its representatives do not provide investment advice or recommendations.

User Eligibility

By using the Services, you represent that you are at least 18 years old, of sound mind, and have the capacity to agree to this Agreement. If using the Services on behalf of a business entity or third party, you represent that you have the authority to bind that entity to this Agreement. Your use of the Services must not violate any applicable laws or pre-existing agreements.

Customer Simulated Trading Experience

The Company does not offer live trading. Traders who pass an assessment may receive simulated capital for demo trading. Data, information, and content related to investment approaches and opportunities are for informational and educational purposes only and do not constitute investment advice. All simulated trading occurs through a third-party data and platform provider.

Limited License

You have a limited, non-exclusive, non-sublicensable, non-assignable, revocable, and royaltyfree license to use the Services for their intended purposes. You may not scrape, frame, hack, reverse engineer, crawl, or aggregate the Services or the Company Website without written consent. This license does not grant you any intellectual property rights. The Company may substitute your trading software if necessary and does not guarantee continuous service.

Prohibited Uses

You may not use the Services to violate laws, intellectual property rights, privacy rights, or other third-party rights. You may not scrape, crawl, frame, post unauthorized links to, aggregate, hack, perform denial of service (DOS) attacks on, reverse engineer, or circumvent technological protection measures of the Services or the Company website. You also may not use the Services or the Company website to transmit unsolicited commercial emails.

Education

The Company does not provide trader education. It aims to identify individuals with trading talent. No live trading is offered. Data, information, and content related to investment approaches and opportunities are for informational and educational purposes only and do not constitute investment advice. The Company does not guarantee the accuracy or completeness of such information and is not liable for any damages arising from your use of it. The Company does not offer opportunities to invest actual currency and emphasizes the risks involved in trading and investing.

Account Creation

To register as a Trader, you may need to provide personal information. Your account is personal and cannot be shared. You are responsible for maintaining the confidentiality of your login credentials.

Purchases and Refunds

The Company may offer products, services, subscriptions, or access at a cost. Prices and availability are subject to change. All purchases are final and non-refundable.

Conduct

Professional behaviour is expected from all traders. Discriminatory behaviour, harassment, or victimization is not allowed and may result in termination of the relationship.

Guidelines

The Company’s guidelines, which may change, are incorporated into this Agreement. The Company does not guarantee employment, monetary payments, or any other compensation for your performance as a Trader.

Trademarks

All trademarks on the Company website are owned by or licensed to the Company. You may not use them to cause confusion, mistake, or deception. All intellectual property rights are reserved by the Company and its suppliers.

Disclosure Statement

Before participating in financial markets, consider your investment objectives, experience, and risk appetite. Do not invest money you cannot afford to lose. Over-the-counter transactions involve risks, including leverage, creditworthiness, limited regulatory protection, and market volatility. Internet-based trading systems also have risks.

Term and Termination

The Agreement begins when you purchase a Service and continues until terminated by the Company or you stop using the Services. The Company may terminate the Services or your access at its discretion.

Disclaimer of Warranties and Limitation of Liability

The Service and Company Website are provided “as-is” without any warranty. The Company is not liable for any claims or damages arising from your use of the Service or Company Website. Your use is at your sole risk, and the Company’s liability is limited to the amount you paid or $1,000, whichever is less.

Indemnification

You agree to indemnify and defend the Company and its affiliates from any losses arising from your use of the Website, violation of this Agreement, or violation of third-party rights or laws.

Arbitration

Disputes arising from this Agreement will be settled by arbitration under the most recent commercial arbitration rules.

Force Majeure

The Company is not liable for issues caused by events beyond its control, such as civil unrest, war, government actions, natural disasters, market conditions, or communication failures.

Survivability

Your representations, warranties, duties, and covenants survive termination of this Agreement.

Severability

If any provision of this Agreement is deemed invalid, the remaining provisions remain in effect.

Interpretation

This Agreement is interpreted as drafted by both parties.

Assignment

You may not assign your rights and duties under this Agreement. The Company may assign its rights and duties.

Waiver

No waiver is valid unless in writing and signed by the waiving party.

Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements.
